Possible Misdemeanor From Hidden Motor Vehicle Law |

In New York State (and perhaps in other parts of the
United States), you are required to report all accidents to the state
motor vehicle department. It does not matter where the accident happened
or when, even if it takes place on private property in a parking lot and
only a steel post damages your car. In NY state, failure to report ANY auto accident (injuries or not) within 10 days can result in: * Suspension of your driver's license * Suspension of your vehicle registration * Misdemeanor charges New York has quietly enacted this idiotic law which virtually no one knows about. And possibly other states have done so, too. Here (pdf) is the crammed 1 page NYS form. Some information for it you may need to obtain from your insurance company. In NY state, it makes no difference whether anyone was hurt or not. You cannot take the form to a motor vehicle bureau office; they refuse to accept it. It must be mailed to Albany, NY at the address shown on the form. Wise people will send it registered mail, return-receipt to make certain your know the bureaucrats received. Do NOT trust the US mail to something this important. How do I know all this? After a minor fender-bender caused by hitting a steel post in the dark while pulling out of a parking space in a mall parking lot, 12 days later I received a letter in the mail from my insurance carrier. It stresses the importance of filing a motor vehicle accident report. Even the clerk at the post office never heard of this law. She (and anyone else with this problem) could lose their job simply by a misdemeanor appearing on her record - caused by innocently breaking a law she knew nothing about. Ted Twietmeyer |
