Iserbyt Update - Justice In The State Of Maine? |
From
Charlotte Iserbyt |
Dear Fellow American... If you are able to find a journalist who appreciates Article I of the Bill of Rights (free press and public's right to know), give him or her the Letter to Judge and the Motions ( see these pdf links ... Motion To Release and Draft Letter To Clerk And Chief). The draft letter to judge and the draft motions are attachedabove. You need write nothing. Journalist can omit wording in # 1 Motion, first sentence, about having published an article of mine. Here is corrected wording for first sentence of Motion #1: "1. The above matters, which relate to the unprosecuted attempted murder of Samuel Iserbyt by Frederick Otis Dodge, were dismissed with Prejudice on or about April 20, 2017." Journalists of all political persuasions should be concerned over the impounding (sealing) of legal proceedings to keep public from knowing what has taken place in any particular case. Here is a superb article by a well-known Maine lawyer that explains the need to hold onto the Bill of Rights, Article I (freedom of press): http://www.courts.maine.gov/maine_courts/committees/tap/Public-Access-MaineBarJournal.pdf You can contact editors of tiny, mid-size, city, and national newspaper editors and talk show hosts. Tell them Charlotte is also available for interviews. This requested action, although helpful to Sam, is not really about Sam. It is about the future of Article I, Bill of Rights: "Congress shall make no law respecting the establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, OR OF THE PRESS, or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. The above Article I clearly calls for the press and public to have access to judicial records which may contain information regarding potential misdeeds affecting a defendant. Please contact me by email (dumbdown00@yahoo.com or phone (207-737-4730/522-8150 (cell) with any questions you may have, and, of utmost importance, inform me of status of your attempt to get this important matter before the Municipal Judge, Cumberland County, Maine. We need to know how many of you have been successful in your efforts, with details regarding name of journalist, date journalist forwarded his Letter and Motions to Judge etc. We, of course, want to have a copy of any response from Judge and information regarding lack of response. While your effort is first and foremost an effort to support Article I, you are at the same time supporting Sam's efforts related to the two attempted attempted murders and mishandling of his case by the Cumberland County District Attorney's office, in collusion with some, (NOT ALL) members of the Portland Police Dept.
