- Dear Mr. Smith;

- Please note the sequence of events starting in November
2010:
-
- 1] On or about November 2010, without permission, SDG&E
trespassed on my property to install a Smart Meter.
-
- 2] Previous to installation of the Smart Meter, as an
Environmental Physician and radio talk host, I have done research into
Smart Meters. As you can see it is very thorough. Thus, you can see why
I did not want a Smart Meter on my home.

- 3] I have addressed this issue re the without permission of
a Smart Meter on my home, and have repeatedly requested a switch back to
an certified SDG&E Analogue Meter.

- 4] Jim Turman, responded in writing from SDG&E refusing
to remove the Smart Meter and replace with an approved analogue meter.
He included a referenced report which does not support the CPUC or SGD&E
position that there is no medical danger from these Smart Meters.

- 5] I secured the following apparatus, HF 35C HF-Analyzer
from LessEMF to analyze the radiation emitted and power levels from the
Smart Meter, and identified power peak levels every 2 to 15 seconds, per
2000 uWatts/square meter.... I have done repeated readings over many days
and times per day. My credentials are attached.

- 6] I have written them and told Jim Turman, that I would
be placing a certified August 1st 2011 GE analogue meter.

- 7] SDG&E did not respond, and due to time period
I assumed acquiescence. We waited approximately a month, from August 2011.

- 8] Since the installation, I suffered from severe insomnia
and polymyalgia, 10 feet from my studio desk. The peak energy levels thousands
of times per day is equivalent to thousands of cell calls in proximity
to my work desk.

- 9] Penal Code 593 -- At any time during this process,
since SGD&E had a remedy to stop the crime they allege, which is to
cut the power. But to continue, after this delay, implies that SGD&E
is complicit, culpable in this ongoing act they allege.

- 10] Tracey, an SGD&E technician, took with her and
had the Smart Meter in her possession since September 13, 2011. She stated
she would have a meter reader come out at the end of September, 2011 and
subsequently we received our September bill using our Analog Meter installed
by a certified electrician and videotaped. Our SDG&E bill is paid in
full to September 28, 2011. This implies that SDG&E acquiescence to
reading from our certified GE Analogue Meter and our ongoing request to
have SDG&E remove the cage only to place a similar Analogue Meter as
prior to November 2010.

- 11] Monday, Oct 10th, two SDG&E technicians came
to my home in the AM to replace our analogue meter with a smart meter.
They asked if we had received the certified letter from SDG&E.

- 12] The SDG&E remedy is to certify the existing meter
or replace with an analogue meter.

- 13] Our bill from September 2011 from Sept 13th 2011
when the analogue meter was switched dropped from $790 to $630, which had
jumped up dramatically after Nov 2010 Smart Meter installation. It is evident
that SDG&E has been overbilling me since November 2010 installation
against my permission. GE certified my analogue meter August 1st 2011,
and thus my power usage is accurate to date. The SGD&E have unjustly
enriched themselves by overcharging me per latest bill with virtually identical
usage patterns.
